These Terms & Conditions (“Terms”) govern your access to and use of digital products, coaching programs, courses, templates, stationery, consulting, and other services (collectively, “Products”) provided by Rachael Peffer, Ltd. (“Company”, “we”, “our”, or “us”). By checking the box on a checkout page and completing your purchase, or by otherwise accessing or using our Products, you (“Customer”, “you”, or “your”) agree to be bound by these Terms.
Websites & Platforms Covered
These Terms apply to all Products offered by Rachael Peffer, Ltd., including content sold or accessed through our website(s) and affiliated platforms such as Showit, HoneyBook, Flodesk, Canva, Stripe, Etsy, Shopify, Instagram, YouTube, and other official channels.
1. Eligibility & Capacity
By using our Products you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.
2. Intellectual Property + License
All content in our Products—including but not limited to videos, templates, PDFs, graphics, logos, written material, and course content—is the intellectual property of Rachael Peffer, Ltd. and is protected by applicable intellectual property laws.
When you purchase or download a Product, you receive a limited, non-transferable, non-exclusive license for individual use and internal business use only (your own business), unless otherwise stated in writing by the Company.
You may not (and agree you will not):
Share, distribute, forward, resell, sublicense, publish, or publicly display any Product (in whole or part)
Upload Products to a shared drive, group folder, membership, classroom, team workspace, or community—paid or free
Create derivative works that are substantially similar for resale or distribution
Remove copyright, trademarks, or proprietary notices
Claim the content as your own
Unauthorized sharing, distribution, resale, public performance, or creation of prohibited derivative works is prohibited and may result in immediate termination of access and legal action.
Use of Likeness & AI Restrictions
You may not use any photographs, video, voice, likeness, or other content from Rachael Peffer, Ltd. (including appearances in video content or public platforms) to train, generate, replicate, or reproduce content using artificial intelligence or machine learning tools (including deepfakes, voice replication, or image-generation tools). Such uses are strictly prohibited and may lead to legal action for violation of publicity or intellectual property rights.
3. Coaching & Educational Disclaimer
Our coaching, consulting, and educational content is for informational and educational purposes only and does not constitute legal, medical, tax, or financial advice. You are solely responsible for your actions and results.
4. Testimonials & Results
Testimonials reflect individual experiences and do not guarantee similar results. Any income or result examples are illustrative only and depend on multiple factors including your effort, experience, implementation, and market conditions.
5. Assumption of Risk
You acknowledge that business decisions involve risk. You assume full responsibility for decisions made as a result of using our Products and agree that we are not liable for any losses arising from those decisions.
6. Refunds & No-Refund Policy
Digital Products & On-Demand Courses: Unless otherwise stated at purchase, digital downloads and on-demand courses are final sale and non-refundable.
Live Programs, Coaching, & Custom Work: Refunds, exchanges, and cancellation terms for live programs, cohorts, multi-session coaching packages, or custom stationery/design work will be specified on the sales page, enrollment agreement, or invoice. Those terms control.
Legal Exceptions: We will honor refunds or consumer protections required by applicable law.

7. Access, Delivery & “Lifetime of the Course”
Products are delivered digitally through email and/or third-party platforms. You are responsible for ensuring access to the email address used at purchase and maintaining access to required technology.
For courses, access is provided for the lifetime of the course, meaning for as long as the course remains available on our platform(s). We may update, modify, reorganize, relocate, replace, or discontinue Products at our discretion.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL RACHAEL PEFFER, LTD. BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS) ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT PAID BY YOU TO US FOR THE APPLICABLE PRODUCT IN THE 12 MONTHS PRIOR TO THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Rachael Peffer, Ltd., its officers, employees, contractors, and affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or misuse of the Products.
10. Termination of Access
We may suspend or revoke your access to Products if you violate these Terms. Where reasonable, we may provide written notice and (where reasonable) five (5) business days to cure the violation. No refunds will be issued for terminated access unless otherwise required by law.
11. Dispute Resolution & Arbitration
We prefer to resolve disputes informally. If we cannot resolve a dispute, you and we agree to resolve disputes by confidential, binding arbitration in Douglas County, Colorado under the American Arbitration Association (AAA) Consumer Arbitration Rules (or another mutually agreed arbitration provider). You and we each waive the right to a jury trial and to participate in a class action. Judgment on an arbitration award may be entered in any court with jurisdiction.
12. Governing Law & Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Douglas County, Colorado, and you consent to personal jurisdiction and venue there.
13. Modifications
We may update these Terms at any time. We will post the updated Terms on our website with a revised “Last Updated” date. Continued access or purchase after changes constitutes acceptance of the revised Terms.

15. SMS / Text Messaging
If you provide your phone number at checkout, through a lead form, or by opting in, you consent to receive recurring automated promotional and personalized messages (e.g., program updates, offers, launch announcements) from Rachael Peffer, Ltd. Consent is not a condition of purchase. Message and data rates may apply. Frequency varies. Reply STOP to opt out or HELP for assistance. We will not sell your mobile number; data is handled per our Privacy Policy.
16. Changes to Products & Availability
We may modify, pause, or discontinue any Product or feature at any time. If a Product is materially changed, we will notify customers if reasonably possible; refunds for discontinued Products will follow the refund terms above.
